1. Copyright and Intellectual Property All original artworks, images, and content on this website are the original work and exclusive property of Rebeca Bradway and are protected by Copyright Law.  The purchase of a physical artwork does not transfer the copyright or any reproduction rights to the buyer. The buyer owns the physical object but does not have the right to copy, photograph, display publicly, or create derivative works from the art without explicit written permission. Reproduction or use without written permission is prohibited.

2. Commissioned Works and "Work for Hire" Unless a written contract explicitly states that a work is created as "Work for Hire," the artist retains all intellectual property rights.  In standard commissions, the patron owns the physical painting or piece, but the artist retains the copyright. Any transfer of IP rights must be documented in a signed agreement. 

3. Moral Rights In accordance with the Visual Artists Rights Act (VARA), the artist asserts their moral rights, including the right to attribution and the prevention of intentional distortion, mutilation, or modification of the work that would be prejudicial to their honor or reputation.  Note that these rights do not apply to illegal graffiti or works created without property owner consent. 

4. Business and Independent Contractor Status Rebeca Bradway Art operates as a small business and independent contractor. All sales are final unless otherwise specified in a written agreement. Buyers are responsible for ensuring they have the right to use the artwork for their intended purpose, particularly regarding the Right of Publicity if the art depicts identifiable individuals for commercial use. 

5. Limitation of Liability While efforts are made to ensure color accuracy, actual artwork may vary slightly due to monitor settings and printing processes. Rebeca Bradway Art is not liable for any damages arising from the use of the artwork.
